1. Digital Millennium Copyright Act Compliance

Cybeauty respects the intellectual property rights of others and expects all creators and users of our services to do the same. It is our policy to respond to valid notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act of 1998 (“DMCA”) and to take appropriate action under the DMCA.

This policy outlines how to file a copyright complaint or a counter-notice if your content has been wrongfully removed.

2. How to File a DMCA Takedown Notice

If you believe that your copyrighted work has been used on the Cybeauty platform in a way that constitutes copyright infringement, please send us a written notice that includes all the following:

• Your full legal name and contact information (email and mailing address)

• A description of the copyrighted work that you claim has been infringed

• The exact URL(s) or location on our site where the infringing material is located

• A statement:
  “I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law.”

• A statement:
  “I swear, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner or authorized to act on the owner’s behalf.”

• Your electronic or physical signature

Notices that fail to meet the above requirements may not receive a response.

3. What Happens After We Receive a Notice

Upon receiving a valid DMCA takedown notice:

• We will promptly remove or disable access to the allegedly infringing material.

• We will notify the user or creator who uploaded the material.

• We may terminate repeat infringers’ access to the platform in accordance with our Terms of Service.

4. How to Submit a DMCA Counter-Notice

If you believe your content was removed by mistake or misidentification, you may file a counter-notice with us that includes the following:

• Your full legal name and contact information (email and mailing address)

• A description of the content that was removed and the location where it appeared before removal

• A statement:
  “I swear, under penalty of perjury, that I have a good faith belief that the material was removed as a result of mistake or misidentification.”

• A statement:
  “I consent to the jurisdiction of the federal district court in my jurisdiction, and I will accept service of process from the person who provided the original DMCA notification.”

• Your electronic or physical signature

If we receive a valid counter-notice, we may restore the content after 10 business days, unless the original claimant notifies us of a legal action.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Cybeauty maintains a policy to terminate, in appropriate circumstances, users or creators who are repeat infringers.

6. Important Notes

• Submitting false DMCA notices or counter-notices may subject you to legal liability under Section 512(f) of the DMCA.

• Because Cybeauty exclusively features AI-generated content, we take extra precautions to ensure that no content submitted mimics, replicates, or violates the rights of real individuals or existing IP.
