1. Acceptance of Terms

By accessing or using any part of the Cybeauty ecosystem (including our website, digital magazine, creator platform, or affiliated services), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our services.

2. Who We Are

Cybeauty is a digital media and content platform featuring AI-generated female models and influencers. Our ecosystem includes:

• A digital PDF magazine, subscriptions, calendars, printables, brochures (SFW and NSFW/adult editions available at adult.cybeauty.ai )
• Infrastructure for the AI & creator economy available at vault.cybeauty.ai
• AI model licensing & agency services available at cyberbeauty.net
• A subscription based creator platform, Cybeauty Club, available at club.cybeauty.ai
• Social media content and virtual influencer engagements

3. Eligibility

You must be 18 years or older to access any part of the Cybeauty ecosystem, especially sections containing NSFW/adult content. By using our services, you confirm that you meet this age requirement. Any breach of this requirement will result in a permanent ban from our platforms.

4. User Accounts

Some areas of the platform (e.g., store purchases, Cybeauty Club) require account registration. You agree to:

• Provide accurate and complete information
• Keep login credentials confidential
• Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Use of Content & Intellectual Property

All digital products available on Cybeauty platforms, including but not limited to magazines, printables, calendars, brochures, and other digital products, are provided strictly for personal, non-commercial use. Any form of reproduction, redistribution, resale, public display, or sharing (whether in part or whole) is strictly prohibited without explicit written permission from Cybeauty. Violation of this policy may result in legal action and permanent suspension of access to our platforms.

You may not:

• Reproduce, copy, sell, or distribute our content without written permission
• Misrepresent AI models as real individuals
• Use AI personas or images for deepfakes or identity misuse

License holders (e.g., through persona partnerships or sponsored models) will be provided a separate licensing agreement.

6. AI-Generated Models Disclaimer

All visual representations of people on Cybeauty platforms are 100% AI-generated. They are not real humans and do not depict actual individuals. Any resemblance to real persons is purely coincidental.

We do not host user-generated real-person content and we thoroughly verify user uploads (on club.cybeauty.ai).

7. Paid Tools

a. Proof of Character – Certificate Generator and Validator

By using the Proof of Character Certificate Generator provided on vault.cybeauty.ai you agree that the generated certificates serve as a declaration of ownership and licensing terms as entered by you, the user. Certificates are issued with a unique ID and stored in our public registry so that third parties can validate authenticity. The registry confirms only that a certificate was issued through our system; it does not constitute legal proof of copyright or intellectual property ownership. You are solely responsible for the accuracy of the information you submit. We reserve the right to revoke or invalidate certificates in cases of suspected fraud, abuse, or non-compliance with these Terms. 8. Purchases & Billing

a. Digital Magazine Purchases

• PDF issues, subscriptions, calendars, printables, and other adult digital products are available only on adult.cybeauty.ai
• All sales are final; refunds are only granted in cases of duplicated payments or access errors

b. Agency Services

Our agency offerings, as featured on cyberbeauty.net, include the following services:

• AI-Influencer Creation & Management
• Persona Licensing & Brand Partnerships
• AI Agents & Workflow Automation
• AI Video Generation and Marketing Campaigns
• AIOFM (AI OnlyFans Persona)
• Custom solutions

These services are custom projects and may require onboarding, development time, and creative direction. Most engagements will require a signed service agreement, a contract outlining the scope, deliverables, timeline, usage rights, and payment terms, and a non-disclosure agreement (NDA).

Billing and Payment:

You may be billed through one-time invoices or recurring payment schedules, depending on the nature and duration of the service. All payments must be made via the approved payment methods listed in the invoice. Fees are non-refundable once work has commenced, unless otherwise stated in your agreement or contract.

Recurring Payment Authorization:

For services billed on a recurring basis (e.g., ongoing content packs, influencer management retainers, or subscription-style agency packages), the following applies:

1. The billing interval and amount will be clearly stated in your signed service agreement prior to the start of services.
2. Clients will receive a confirmation email upon entering into a recurring agreement, outlining the package, billing amount, and frequency.
3. Clients will receive advance notice by email at least 5 business days before each recurring debit.
4. Recurring billing continues for the duration of the agreement unless the client cancels in writing, subject to the termination provisions in the service agreement.
5. Cancellation requests must be submitted at least 14 days prior to the next billing date to avoid further charges.

By entering into an agency agreement that includes recurring billing, you attest that you understand these terms and consent to scheduled debits as agreed upon.

Dispute Resolution:

In the event of a disagreement regarding service delivery, billing, or other contractual matters, both parties agree to attempt to resolve the issue through direct negotiation within 14 days of the dispute being raised. If no resolution is reached, the matter will be referred to arbitration under Romanian law. The arbitration will be held in Bucharest, Romania, and conducted in English. Any outcome of arbitration will be final and binding.

By purchasing or engaging in agency services, you acknowledge that you’ve read, understood, and accepted these terms.

c. Cybeauty Club Subscriptions

• Creators may monetize content through a paywall
• Transactions are handled through a secure payment gateway
• Users are responsible for managing their subscription status

Recurring Payments

By subscribing to Cybeauty Club, you authorize Cybeauty to charge the subscription fee at the stated interval (monthly or yearly, depending on your chosen plan). Subscription fees may vary depending on the selected package, and the applicable amount will always be clearly displayed before purchase.

Subscribers will receive:

1. A confirmation email at the time of subscribing, including details of the package, billing amount, and billing interval.
2. An advance email notice at least 3 days before each recurring debit, reminding them of the upcoming charge.
3. The ability to cancel at any time through the account settings. Cancellation will take effect at the end of the current billing cycle, and no further charges will be made thereafter.

By completing a subscription, you attest that you understand these terms and consent to recurring billing until cancellation.

9. Creator Platform (Cybeauty Club – club.cybeauty.ai)

If you’re a creator accepted into Cybeauty Club, additional terms will apply. You must:

• Must have 21 years or older
• Upload only AI-generated content
• Own or hold the rights to your AI models
• Avoid unlawful, violent, or exploitative materials

We reserve the right to reject or remove content that violates platform guidelines.

10. Acceptable Use Policy

You may not use Cybeauty to:

• Violate any laws or regulations
• Harass, abuse, or threaten others
• Upload viruses, malicious code, or spam
• Use scraping, bots, or automated access tools

We reserve the right to terminate access or block users who engage in disruptive or abusive behavior.

11. Third-Party Services & Links

Our services may include links to third-party websites or platforms (e.g., Instagram, Threads). Cybeauty is not responsible for third-party content, policies, or practices.

12. Affiliate Disclaimer

Certain links and promotions found on Cybeauty platforms may be affiliate links. This means we may earn a commission if you click a link and complete a qualifying purchase or action with a third-party provider.

Cybeauty does not own or control these third-party websites or services. You acknowledge that any transactions made via affiliate links are solely between you and the third-party entity. We are not responsible for the content, offerings, or conduct of affiliate partners.

13. Termination

We may suspend or terminate your access to Cybeauty at any time, without notice, if we believe you’ve violated these Terms, engaged in illegal conduct, or harmed the Cybeauty brand or its users.

14. Disclaimers

• All content is provided “as is” with no guarantees regarding accuracy, availability, or uptime.
• We are not liable for damages resulting from use of or inability to access our services.

15. Limitation of Liability

To the maximum extent permitted by law, Cybeauty, its affiliates, directors, employees, or partners shall not be liable for:

• Indirect, incidental, special, punitive, or consequential damages
• Loss of profits, revenue, data, or goodwill
• Business interruption or platform downtime
• Any user misunderstanding, reliance on, or emotional distress from interactions with AI personas
• Any content created, posted, or distributed by third-party creators on the platform
• Unauthorized access to or use of your personal information or account
• Content viewed, downloaded, or purchased through the Cybeauty ecosystem (including NSFW material)

Cybeauty’s total liability arising out of or related to your use of the platform shall not exceed the total amount paid by you (if any) within the past twelve (12) months.

16. Compliance Policies for Age Verification, Content Screening, and Reporting

Cybeauty follows a structured compliance framework to meet industry, legal, and payment processing requirements (including those required by adult content merchant processors):

a. Age and Consent Verification

Cybeauty does not allow real-person content and only features AI-generated visuals. For creator uploads (e.g., on club.cybeauty.ai), all content must be certified as AI-generated by the user. We have a mandatory screening process in place to reject any content suspected to involve real individuals. Accounts that violate this rule are permanently banned.

b. Pre-Screening and Content Approval

All content uploaded to the platform is subject to pre-screening using a combination of automated filters and manual moderation. Our team reviews content before it is made public to ensure it complies with platform policies, including prohibitions on unlawful, violent, exploitative, or deceptive material.

c. Ongoing Monitoring and Review

Published content is subject to ongoing moderation, flagging systems, and periodic audits. We use automated tools and manual checks to regularly review content for compliance and safety, including NSFW content. Content may be removed or restricted if it violates our policies.

d. User Reporting System

Users can report content that they believe is illegal or violates our platform rules. Reports are handled through the Cybeauty Club platform or via direct contact at [email protected]. Our moderation team investigates all reports promptly and takes appropriate action.
